If anyone knows the law, forward and backward, it is a judge. Particularly a judge on the Supreme Court. But former Wisconsin Supreme Court Justice Michael Gableman has worked hard to skirt the laws regarding the retention of public documents. Gableman is heading an “investigation” into the 2020 election in Wisconsin, at a cost to taxpayers of some three-quarter of a million dollars. But now we’re learning that Gableman and his legal team have admitted to regularly deleting emails and text messages related to the investigation. His lawyer says they delete those which are not of use to the investigation. But it seems that isn’t their decision to make. Wisconsin’s laws on open records are pretty clear, although Gableman would like to think he is exempt. Legislative lawyers had told Gableman earlier that the laws apply to him, but he has chosen to ignore them and their advice. This shouldn’t be a shock, given that it took lawsuits to compel Gableman, and the man who hired him, Speaker Robin Vos, to produce previous emails requested under the open records laws. Taxpayers funding this investigation should not be left in the dark about how it is playing out, and those being paid shouldn’t be working so hard to cover up their tracks. Certainly, a former justice on Wisconsin’s highest court should know that.
