Alleged sexual assaults in Loudoun County schools raise questions about Virginia law - WSET

LOUDON COUNTY, Va. (WSET) — A law is resurfacing following an incident in Loudoun County where one student allegedly is responsible for two sexual assaults in different area high schools.

Some parents and local lawmakers are now taking issue with House Bill 257. The law passed last March doesn’t require principals to report certain misdemeanor acts to law enforcement, including sexual battery.

The Sheriff’s Department charged a student for both sexual assaults. They also confirm the district reported the first incident, and the second the district alerted the sheriff.

Some parents and lawmakers, like State Senator Mark Peake, take issue with why the student was not immediately expelled. They are calling for transparency from the district.

“That you can have a student be accused of a rape on school property in the girls' bathroom and conceal it from the school board, possibly, and then put that student in another school is absolutely horrific," Peake said.

Local Democrat state senators and delegates and Democrat candidate for governor Terry McAuliffe could not be reached for comment.

In a statement, the district said the school complied with Title IX about how schools must investigate allegations of sexual harassment and assault in schools. They say it equally protects both victims and alleged perpetrators, and it wasn't enough.

Republican Glenn Youngkin said if he is elected he will demand the repeal of the law passed by Democrats that allows school districts to "cover up serious crimes."

"Never again will radical school boards be able to hide criminals in our schools," Youngkin said.
