Belmar Public Library Presents: A Disability Law Series on Planning Ahead for Special Needs Children - TAPinto.net
BELMAR, NJ — For families with special needs children, planning for the future requires careful consideration of various legal and lifestyle concerns — a topic that will be explored during a three-part series at the Belmar Public Library.
“Disability Law for Families with Special Needs Children” will be presented by attorney and advocate Tina M. James, who will launch the free program on Wednesday, October 6 at 6 p.m. with an introductory session designed to educate families who have a child, grandchild or a sibling with a disability about special needs planning.
James will discuss the importance of estate planning, the use of special needs trusts, options for selecting trustees, ways to fund a special needs trust, knowing when a guardianship may be appropriate and alternatives to guardianship. She also will provide an overview of government benefits, such as Social Security, Medicaid and other entitlements.

The series continues on Wednesday, November 3 at 6 p.m. with a detailed look at the importance of an estate plan, including what happens without an estate plan or when one is not properly prepared. James also will cover the fundamentals of wills, special needs trusts, durable powers of attorney, medical directives, NJ Able accounts, the transfer of nonprobate assets, such as life insurance policies and retirement accounts, and creating a plan to care for their family member after they are gone.
During the series’ final session on Wednesday, December 1 at 6 p.m., James will focus on ensuring that special needs children have a successful transition to adulthood. She will provide an in-depth look at guardianships, including the difference between a plenary guardianship and limited guardianship, and between a guardianship of the person and guardianship of the estate. Other topics to be addressed include obtaining physician certifications, the role of a court-appointed counsel and options for supported decision-making when a guardianship is not appropriate. In addition, she will discuss applying for entitlements, such as supplemental security income, Medicaid, educational entitlement in the school system, and services offered through the N.J. Division of Developmental Disabilities.
“There is a large community of families in our region with special needs family members,” said library assistant Luis Pulido. “This educational series is designed to provide them with important information and advice from an expert in the field of disability law.”
Throughout her career, James’ legal work has focused on estate planning and administration, guardianship and decision-making, discrimination, special education and special needs planning for individuals with disabilities and their families.
Before starting her own South Amboy-based firm in early 2021, she worked at a boutique law firm serving people with disabilities and their families. Prior to that, the Rutgers University School of Law graduate worked as a litigator with a national law firm where she successfully litigated probate and guardianship matters.
The three-part program will be presented in person at the Belmar Public Library, located at 517 10th Avenue at the corner of E Street. For those who cannot attend, the presentation will also be livestreamed on the library’s Facebook page.
