Can Tweak to NY Bail Reform Law Curb Gun Violence? - Crime Report
Amending New York’s bail reform law to make illegal possession of a weapon grounds for requiring bail can satisfy hardline critics who say the law is responsible for a rise in gun violence, writes Candace McCoy, a professor of criminal justice at John Jay College in New York City, in an op-ed for Bloomberg News. McCoy argues that data does not support claims that bail reform is responsible for a recent uptick in violent crime, including shootings and homicides.
She proposes instead changing the current bail reform law, under which illegal gun possession is considered a non-violent felony, by adding a provision that possessing an illegal weapon constitutes a threat of violence in itself. About 2 percent of accused persons released under the new law, including some charged with violent felonies and given “supervised release,” allegedly committed a crime of violence while awaiting adjudication for the original charges, according to numbers released by the state’s Office of Court Administration.
