The California Environmental Quality Act has seen pushback since it was passed in 1970. The law, which requires vetting the environmental impacts of major development projects or land use decisions, seems smart and straightforward. But critics charge that the regulation has stymied badly needed construction, and been misused by homeowner groups who oppose new housing.
In the past several decades, the outrage has only intensified as the CEQA evolved to what one researcher called a “monstrosity” of a regulatory regime. Recently, homeowners’ use of CEQA to sue the University of California, Berkeley, over its efforts to increase student enrollment has ignited calls to reform the law. But what would that look like?
