Costa Rica: Amendment to the Law Against Sexual Harassment Extends the Statute of Limitations - JD Supra
On October 20, 2021, Law 10029, Amendment to Articles 29 and 38 of Law Against Sexual Harassment, Law 7476, came into force.
This amendment extends the statute of limitations to file a complaint of sexual harassment, from two to eight years, in both the public and private sectors. The eight-year term will begin as of the last sexual harassment conduct occurred or once the cause that prevented the victim from reporting has ended. In the case of minors, the term will run from the moment the minor reaches the legal age.
Article 38 of the law against sexual harassment, in accordance with article 414 of the Labor Code, maintains the provision of a one-month term to sanction sexual harassment conducts, which term begins as of the moment the sexual harassment investigation (following the due process) ends.
