CT Updates Cannabis Law: 5 Things To Know - Patch

The state legislature passed a bill that will make gifting cannabis stricter if signed into law.

CONNECTICUT — The state legislature passed a bill that aimed to curb cannabis bazaars that operated in a gray area since cannabis became legal in Connecticut. The bill now heads to Gov. Ned Lamont's desk for consideration.

One of the most well-known bazaars occurred in Hamden. The town took organizers to court over zoning compliance issues.

Here are five things to know:

How gifting changes under the bill

Current law allows for cannabis to be given to other consumers for free as long as they reasonably believe the person won't exceed the state's ounce limit.

The bill clarifies that cannabis can't be "gifted" in exchange for donations or donations to gain admission to an event.

Cannabis also can't be given away as a door prize, goodie bag or swag bag, according to the state Office of Legislative Research.

Advertising changes

The bill also restricts cannabis advertising, so out-of-state businesses and individuals can't advertise any cannabis or related service.

Billboard advertisements will be limited to between 11 p.m. and 6 a.m., except for certain outdoor business signs at cannabis establishments.

Fines

Municipalities can levy up to $1,000 per offense. The state can levy a $1,000 fine and potentially up to $1,000 in fines for failure to pay taxes.

Other changes

Physician assistants will be able to prescribe medical marijuana. Current law allows physicians and APRNs to prescribe. Only a physician can prescribe for glaucoma, but PAs and APRNs can prescribe for other reasons. There are other changes in the bill as well.

When will recreational cannabis dispensaries open?

Recreational cannabis was approved for adult use in June 2021, but the state is still getting its regulatory system in place for recreational dispensaries. The state has had medical dispensaries for years.

The state Department of Consumer Protection estimates that retail sales will begin by the end of 2022.
