DOL Job Benefits Law Specialist Sees Suit Over Removal Revived - Bloomberg Law

A Taiwanese former employee benefits law specialist with the Department of Labor was right that her settlement of an earlier job discrimination case didn’t bar her subsequent lawsuit over her termination, the D.C. Circuit ruled Friday.

A lower court misinterpreted Karin Weng’s settlement agreement in the prior suit, the appeals court said. It included a carve-out that expressly referenced a union grievance Weng filed over her removal from her position, which was then on appeal before the Merit Systems Protection Board, the court said.
