Dunlap father helps pass new guardrail law after daughter killed by defective rail - WTVC

DUNLAP, Tenn. — Stephen Eimer waited with baited breath as congress passed a new infrastructure bill.

The more than $1 trillion infrastructure package will allow for several improvements across the state of Tennessee. But, Eimer's was focused on the updated crash certification standards.

Eimers became an advocate for defective infrastructure reform after his daughter Hannah was killed after crashing into an X-Lite guardrail in McMinn County in 2016.

The X-lite rail was supposed to collapse, instead it punctured her car, killing her instantly.

There have been several other instances where these guardrails acted like a spear shooting through the vehicle, instead of collapsing.

After 5 years of advocacy, Eimers was able to add a law to President Biden's infrastructure bill that requires new measures on how guardrails are tested and implemented.

Eimers says the guardrails that killed his daughter were self-certified by the Lindsay Corporation.

"Everywhere that we have seen this product installed. We have seen spearings," says Eimers.

According to the Government Accountability office, since that crash, another 10 deaths from X-lite guardrails were discovered.

We reached out to Lindsay Corporation about their guardrails and they say at the time the guardrails met safety standards.

"This is not going to bring Hannah back, but this will prevent a company from Wednesday Corporation from fraudulently testing their own product," says Eimers.

Now with updated testing standards, Eimers hopes the new law will prevent future tragedies.
