Federal judge delays trial on NC's voter ID law - WRAL News

A federal trial on North Carolina's voter ID law, once planned for next month, is on hold while the U.S. Supreme Court decides who should defend the law in court.

U.S. District Court Judge Loretta Biggs ordered the delay Thursday, saying it doesn't make sense to start without this input from the nation's high court. Going forward would potentially mean having to hold the trial twice, "needlessly expending tremendous resources of time and effort" and potentially confusing voters, Biggs wrote in her order.

"North Carolina’s voter ID requirements have already been subject to extensive judicial intervention at both the federal and state levels, occasionally resulting in conflicting orders," Biggs wrote.

, top leaders in the North Carolina General Assembly's Republican majority, believe they should be defending the state's voter ID law, which their legislative majority wrote. At the moment Attorney General Josh Stein, a Democrat, is defending it in federal court, even though North Carolina Democrats generally have opposed the law.

Federal judges in lower courts have repeatedly found Stein's defense adequate, but the Supreme Court may allow Berger and Moore to bring in their own legal team. The high court is expected to decide this by the summer, and Biggs said the regular trial will proceed once it does. It had been planned for January 24.

For now North Carolina voters don't have to show photo ID at the polls, despite a 2018 constitutional amendment requiring it. There are also two other lawsuits, both at the state level, challenging this law. One is pending before the North Carolina Supreme Court, the other before the N.C. Court of Appeals.
