Fort Myers man sentenced 30 years for robbery, threatening law enforcement - Wink News

A Fort Myers man who attempted robbing a store in 2019 and tried fleeing from law enforcement in 2021 has been sentenced to 30 years in prison.

According to the State Attorney’s Office, Robert Diaz attempted to rob a tire shop in Pine Island Road in Lee County in 2019. During that attempted robber, Diaz was shot in the face by a man who was cleaning his gun in the store.

Diaz was sentenced to 30 years in prison for one count of attempted robbery, possessing a firearm. He was also sentenced to 30 years in prison for one count of first-degree
burglary and 30 years in prison for one count of possession of a firearm by a convicted felon. Those sentences will be served concurrently.

In 2021, Diaz was fled from law enforcement for failing to come to a stop when on a bicycle. While fleeing, he dropped a book bag containing a 16-gauge shotgun and a flare gun, spray-painted black engraved with a swastika.

Deputies arrested Diaz for fleeing, and while being transported, deputies say he threatened them and admitted to being involved in the tire shop robbery.

Diaz was sentenced to 60 months in prison for one count of fleeing/eluding a law enforcement officer with lights and sirens, 30 years in prison for one count of
possession of a firearm by a convicted felon, 60 months in prison for threats of intimidation of death or serious bodily harm to a law enforcement officer, and 15 years in prison for possession of a short-barreled shotgun.
