Case No. 19-MJ-00139-MJW (LMC) AFFIDAVIT I, Detective Steve Cook, the undersigned Affiant being duly sworn, state the following is true and correct to the best of my knowledge and belief: 1. I am a Police Officer with the Independence Missouri Police Department, since August 1993, and I am currently assigned as a Detective with the Criminal Investigations Bureau. In connection with my official duties, I have conducted and/or participated in numerous state and federal investigations involving controlled substances and firearms, including the execution of state and federal search and arrest warrants. 2. The information in this Affidavit is based on my personal knowledge and information provided to me by other law enforcement officers and individuals. I have included only the information that I believe is necessary to establish probable cause. The information is not a complete statement of all the facts related to this case. 3. I submit this Affidavit in support of a criminal complaint for an arrest warrant for Saousoalii P. Siavii, Jr., a/k/a “Junior”. Based on the facts below, I believe there is probable cause to believe Siavii, Jr., illegally possessed a firearm as an unlawful drug user, in violation of 18 U.S.C. § 922(g)(3). 4. On April 21, 2018, at approximately 0104 hours, Officer Dallas Burnette with the Independence, Missouri Police Department stopped a black Ford Focus with an improperly registered license plate in the area of 42nd and Lee’s Summit Road, Independence, Missouri. The vehicle was being driven by Saousoalii P. Siavii, Jr., who was also found to be intoxicated. Siavii was arrested for driving under the influence and during a search of his person a small blue straw was located in his wallet that contained a white powdery residue that field-tested positive for cocaine. 5. On January 17, 2019, at approximately 0408 hours, Officer Nick Dorman with the Independence, Missouri Police Department conducted a traffic stop of a black Chrysler 300 for a traffic violation (failure to signal). The vehicle had just left 808 North Crow which is a known drug house and a location where stolen vehicles are frequently observed. 6. The driver of the black Chrysler 300 was later identified as Saousoalii P. Siavii, Jr., who was uncooperative with officers by refusing to give them his driver’s license or name. During the contact, Siavii, Jr. told officers that he was going to get his phone and record them and reached under his seat. Siavii, Jr. was given commands to keep his hands on the steering wheel and not to reach under the seat. Siavii, Jr. was asked to exit the vehicle, but he would not comply. He eventually exited the vehicle and pulled away from officers causing the officers to take him to the ground where he continued to resist. 7. Siavii, Jr. was placed under arrest and during a search incident to arrest a white pill fell from his person. Siavii, Jr. advised the pill was Xanax that he had a prescription for but he did not have the prescription bottle with him. Officers located a prescription bottle inside the vehicle during the inventory for tow. That prescription bottle had a female’s name on it and contained 7 ½ Xanax pills, 1 ½ Zolpidem Tartrate and a small quantity of marijuana. Also in the vehicle was a small can containing two straws with a white Case 4:19-mj-00139-MJW Document 1-1 Filed 08/26/19 Page 1 of 4
