The U.S. Court of Appeals for the Second Circuit on Thursday revived a constitutional challenge to a New York City law that prevents commercial landlords from collecting past-due rent from tenants affected by the COVID-19 pandemic.
A divided panel of the Manhattan-based appeals court held that a Manhattan federal judge had improperly dismissed the lawsuit, and remanded the case for a possible hearing on a preliminary injunction to halt the so-called guaranty law.
