Italy: Extra-income transfers from renewable energy plants converted into law - JD Supra
On March 28, 2022, law-decree no. 4 of January 27, 2022 (known in Italian as the Decreto Sostegni-ter) has been converted by law 25/2022 (Conversion Law), and the extra income transfer mechanism is now final.
The Conversion Law repeals entirely law decree no. 13 of February 25, 2022, which had in turn repealed article 16 of the Decreto Sostegni-ter, and instead introduces a new article 15-bis to the Decreto Sostegni-ter.
This new article 15-bis of the Decreto Sostegni-ter, as now converted into law, is practically identical to the simultaneously repealed article 5 of law decree 13/2022, which had introduced a mitigated version of the obligation for renewable energy producers to transfer extra income generated from the exceptionally high electricity prices to the state-owned energy service system operator, Gestore dei Servizi Energetici (GSE), to help fund the reduction in the cost of electricity (see our previous post here).
As a result, nothing has changed compared to the mitigated measure published by the government in February 2022, but the conversion into law has been accelerated.
The Italian Regulatory Authority for Energy, Networks and Environment (ARERA) has waited for this moment to publish, on March 29, 2022, a document for public consultation aimed at issuing the implementing regulations for article 15-bis. Stakeholders can submit their proposals and opinions to ARERA until April 22, 2022. The document is available here.
