Kansas Denied Supreme Court Review of 'Ag Gag' Law Provisions - Bloomberg Law

A lower court’s decision to toss certain parts of Kansas’ law that prevents animal rights and food safety groups from using deception to investigate agricultural facilities won’t face the Supreme Court’s review.

The high court’s decision Monday came as a win for groups that challenged the state’s so-called “ag gag” law. The law criminalized recording and trespassing on a facility without consent and with the intent to damage the enterprise.

The U.S. Court of Appeals for the Tenth Circuit ruled in August that those provisions discriminated on the basis of viewpoint and violated the First Amendment.
