KANSAS CITY, Mo. —
Freedom is something Ken Middleton has not experienced for more than three decades. His son believes a new law could help his dad get out of prison. The case has been an object of fascination in Kansas City for years.
In 1991, Middleton was convicted of first-degree murder a year after the shooting death of his wife Kathy Middleton. For the past three decades, his son Cliff Middleton has maintained it was all an accident.
Now, Middleton has renewed a push to get Jackson County Prosecutor Jean Peters Baker to file a motion to vacate his father's verdict.
It could happen under the same new law that pushed her to ask for Kevin Strickland’s release in a separate case. Middleton maintains his dad didn't get the right legal representation at trial, or after.
"The courts have never heard my father's case on the merits and then they need to and Jean needs to file the motion and let a court hear it," Middleton said.
A spokesman for Jean Peters Baker maintains if there is new evidence that comes up, they will look at that. Meanwhile, Middleton wants to keep public attention on his dad's case.
Middleton is serving life without parole, plus 200 years.
