Kingston committee backs passage of Good Cause Eviction law - The Daily Freeman

KINGSTON, N.Y. — A Common Council committee has recommended that lawmakers favor the Good Cause Eviction legislation that now includes a provision that was included in an original proposal, according to council’s Democratic Majority Leader Reynolds Scott-Childress.
The Laws and Rules Committee voted 4-1 on Wednesday, Dec. 15, to recommend the passage of the amended regulation. Last week, the full council had sent the matter back to the panel after complaints arose that exempted owners of less than four rental units from the legislation.
The newest recommendation includes a provision that owners of less than four units must live in the building in order for them to be exempt from the rule, Scott-Childress said.
The legislation stops landlords from removing tenants without an order from a judge, who would decide if an eviction is for a good cause.
Alderwomen Michelle Hirsch, D-Ward 9, and Rita Worthington, D-Wared 4, as well as Scott-Childress, D-Ward 3, and Jeffrey Ventura Morrell, D-Ward 1, voted in favor of recommending the passage of the new legislation. Alderman Donald Tallerman, D-Ward 5, who is a landlord, voted against.
In early December, the Common Council was scheduled to have its “first reading” of a proposed Good Cause Eviction law, but lawmakers opted instead to send the legislation back to their Laws and Rules Committee for further discussion and possible revision. The move came after aldermen heard from several city residents who implored them to move forward with enacting Good Cause Eviction legislation but to remove a clause that had been put into Kingston’s proposal that would have excluded it from applying to buildings with less than four units.
Jonathan Bix, executive director of the group For the Many, told aldermen that limiting the legislation to buildings with more than four units would exclude approximately two-thirds of all renters in Kingston from benefitting from the law’s protections.
Several speakers urged aldermen to enact Good Cause Legislation before the state’s eviction moratorium expires on Jan. 15, but without the clause limiting the number of units.
