WEST PALM BEACH, Fla. (CBS12) — The Kravis Center for the Performing Arts is among dozens of facilities under the microscope by the state for possible vaccine passport law violations.

According to list obtained by CBS 12 News, the Florida Department of Health is investigating the center and other more than 100 other businesses and venues like the Miami Marlins, the Broward Center for the Performing Arts, and even Starbucks.

Gov. Ron DeSantis signed the law in May. It prevents businesses and governments from requiring customers to show proof of a COVID-19 vaccination. The health department is the enforcement arm of the law, and can impose $5,000 in fines per violation.

A spokeswoman for the Kravis Center sent CBS12 News this statement: "The Kravis Center has adopted a Covid-19 policy which we believe is in the best safety and health interests of our performers, patrons, volunteers, staff and the public at large. We believe our policy is in full compliance with all applicable laws."

The Kravis Center's policy requires patrons show proof of a COVID vaccination or a negative test. State officials tell CBS 12 News policy is, in fact, technically in line with the state's ban on so-called vaccine passports.

And, the Kravis isn't the only entity on the state's massive list that is following the rules. CBS 12 News found business after business being investigated by the state, despite the fact their vaccination policies are in line with state regulations.

Starbucks, for instance, is on the state's list. But, the company does not have a vaccine requirement for patrons or employees. The company only encourages employees get vaccinated. West Palm Beach's Norton Art Museum, also on the list, has a similar policy to the Kravis ( allowing a testing opt out) but they are also on the list.

The state's list even mentions a seemingly nonexistent vaccine requirement for an FDLE counterterrorism task force in Jacksonville. It also says the state is looking into the U.S. Department of Defense's requirement that all employees be vaccinated.

Local governments facing inquiries from the state also expressed surprise, saying their policies were compliant with current regulations.

"[Employees] are not being punished [for not being vaccinated],” the Mayor Wayne Messam of Miramar said, regarding his city's presence on the list. “It’s such a surprise we are being investigated and a surprise the city manager would be named individually. There is no penalty for not being vaccinated.”

Miramar has a similar testing opt-out policy.

A Florida Department of Health spokesperson cautioned the list is not a reflection of guilt or even active investigations. Instead, the list is a complication of the complaints the FDOH has received from everyday Floridians regarding businesses and other organizations. Each complaint is currently being assessed.
