Here’s a proposal regarding a state mask mandate: Let the Legislature enact a mandate to wear masks wherever people pack together. Let this law stipulate that state authorities will not enforce the requirement, but that any person may sue for $10,000 the proprietors of establishments or organizers of events who do not require masks. Write the law to reproduce the Texas anti-abortion law (changing the vocabulary for masks instead of abortions). Such a law would certainly be challenged in court and hopefully would be appealed all the way to the Supreme Court. It would be amusing to see what legal contortions the conservative faction performs to permit the law on abortion to stand but to strike down the one on masks.
