Red Hook adopts changes to village zoning law - The Daily Freeman

RED HOOK, N.Y. – Village Board trustees have approved eliminating the Highway Business District designation in favor of a slightly larger Gateway Business District.

The revisions to land use rules were revised in a 4-0 vote Monday following a public hearing that has remained open for three months.

Under the changes, there would also be some properties on East Market Street that will have zoning designations changed from Highway Business to General Business, which will also allow apartments to be constructed in buildings that have commercial uses on the first floor.

“You want your retail on the first floor because it creates a business activity and then you have the people on the second and third floor and you’re creating a mixed-use business environment,” Mayor Karen Smythe said.

One of the goals of the revisions is to encourage more housing in an area where mixed retail and residential uses have not been allowed.

“The apartments above the main buildings (have not been) allowed by zoning,” Smythe said. “You’re allowed one. So we wanted to get that passed.”

One revision sought to clarify how the proposed Gateway Business District differs from the General Business District.

“The General Business District is the core center while the Gateway Business is the area (east along state Route 199) on your way into the village,” Smythe said.

Included in the board approval was overriding Dutchess County Planning Department recommendations that retail and services businesses be excluded as permitted uses in the Gateway District and that building height be limited in the General Business District.

“The whole point was (having) services and retail,” Smythe said. “We already have buildings in the General Business District that are three stories so it didn’t make sense to create a…building law that didn’t incorporate what we already have.”
