Representative Allen Treadaway pushing for legislation to help law enforcement - Alabama's News Leader
House Bill 2 was pre-filed by Representative Allen Treadaway (R) ahead of the legislative session on January 11. This will be the second time the content of this bill will be considered in Montgomery. Treadaway said it was important he pre-filed the bill to give it a better chance of passing after last year's version died in the senate.
"The argument has been, don't we have laws in the books for riots, looting, things like that, and yes we do. But what we don't have on the books is laws to protect police officers when they are trying to keep everyone safe," said Treadaway.
HB2 establishes the Anti-Aggravated Riot Act. Essentially, it would make it a crime to assault a first responder while they are executing their sworn duties.
"If you are not assaulting a police officer, you're not harassing a police officer, you're not spitting on a police officer, you don't have a problem. I bet you the vast majority of society believes when you do do that, there ought to be serious consequences," said Treadaway.
Treadaway served with the Birmingham Police Department for 31 years, retiring as the assistant police chief. He said he served on the front line of many protests and describes the summer of 2022 as 'disturbing,' when peaceful protests turned into riots.
Treadaway claimed many of those involved were from outside the city.
"They were prepared, they were well financed, they placed these devices in the city the night before, in the shrubbery around the bigger buildings and they went to these devices and used them against police officers," said Treadaway.
ABC 33/40 has not independently verified Treadaway's claims, but those claims are not unique to Birmingham. Similar claims are being made in cities across the country.
Regardless, if adopted, HB2 would hold a person for 24 hours if arrested during a riot. It would also increase penalties. Treadaway said this would allow officers to get the scene under control.
Crime in this country is on the rise, violent crime is on the rise at an alarming rate and we got to get back to law and order.
Treadaway is also working on another bill he plans to introduce when the session starts. This bill would give first responders a pathway to civil action when they are assaulted in the line of duty.
