True enough, but if the Texas law were held to be constitutional, it would follow as a matter of law that California or New York legislators could violate the First Amendment by empowering their citizens to enforce statutes that punish Mr. Hughes for his op-ed piece, for example.
The more apt word for the Texas law is not “unconventional” but “unconstitutional.”

Mr. Hughes’s op-ed contains much double talk. For instance: “The law does not ban abortions after six weeks. It requires that a physician performing an abortion first check for a fetal heartbeat. If there is a heartbeat, the physician may not abort the child.” If there isn’t a heartbeat after six weeks, the argument is moot—the fetus is dead.
