Texas AG says Biden administration is 'making a mockery' of federal law, courts - KEYE TV CBS Austin

WASHINGTON (TND) — A record number of apprehensions at the Southern border is raising concerns about border security.
The responsibility typically lies with the federal government but amid what they consider a tepid response from the Biden administration, the state of Texas is taking matters into its own hands.
Texas Attorney General Ken Paxton talks about how the crisis is being handled at the state level and the other issues the state is pushing back on.
“It has been very challenging because we have a federal government, we have a Biden administration, that literally from day one has said, ‘we're not going to enforce the laws,’” Paxton said. “They've basically seceded the border to the cartels, drug trafficking, human trafficking and, obviously, as many illegals as can come through.”
He says that despite a victory with the Remain in Mexico program being reinstated, in order to get the border crisis under control, it needs to be applied to more migrants.
“The problem is when you look at the numbers, the Biden administration is not only going against federal law, they're also going against a court order. They have only applied the Remain in Mexico program — it looks like — for a few hundred people a month. So, they’re making a mockery, not just of federal law but of the federal court system.”
Another issue facing the state is its vaccine executive order, which is in conflict with the CMS mandate for healthcare workers to be vaccinated if they work at a facility that receives federal funding.
Paxton said the state of Texas is looking to challenge the ruling again because he believes it’s adding to staff shortages at already overwhelmed healthcare facilities.
“Right now, we’re looking at other ways to deal with the CMS mandate,” Paxton said. “We're trying to look at other ways, other states to see if we can come back and get another bite at the apple because, certainly, this is having a negative impact on the number of health care workers that we have. It seems to me that we don't have enough of them, so we're actually going to be causing great harm to our health as Americans by forcing a vaccine on people that we need to work that aren’t going to do it.”
He says it’s unfortunate that some Americans are now faced with deciding between their job or upholding a personal belief.
“No American should have to make a choice between their job and what they may believe is best for their health. That's literally not something that government should be able to step into,” Paxton said.
The AG also signed on to fight against the Occupational Safety and Health Administration's proposed "Emergency Temporary Standard," which was an effort to keep the vaccine mandate for large employers in place, despite the Supreme Court ruling overturning it.
OSHA confirmed Tuesday that the Biden administration withdrew the vaccine-or-test mandate for companies with at least 100 employees. Paxton says the president never had the right or the statutory authority to issue the requirement.
“I don't see any real hope for the OSHA mandate despite the fact that the federal government keeps trying to ignore federal law and federal court orders,” he said. “The way I see it is they are sort of operating outside of any kind of authority or outside of any kind of accountability.”
Paxton is up for reelection this year and the primaries begin in March. As voting has been a hot topic recently, some are saying the state’s new voting law for absentee ballots and the number match requirement could be confusing.
“I don't think there's going to be any trouble with voting in Texas,” he said. “The reality is we have almost two weeks of early voting. They've extended the hours so pretty much, I think it goes from 7 a.m. to 7 p.m. every day for almost two weeks. You know, if you want to vote in Texas, you can vote. There's no problem.”
