Town of Saugerties delays action on property maintenance law - The Daily Freeman

SAUGERTIES, N.Y. — The town is giving the public more time to evaluate revisions to a proposed property maintenance law before voting to adopt the regulations.

Saugerties Supervisor Fred Costello said he expects the Town Board to vote on the proposal in the next six weeks.

A vote initially was planned for earlier this month, but town officials tapped the brakes amid concerns about residents’ privacy being compromised – for example, by a code enforcement officer coming onto a property without permission from the owner.

“Some of the remaining concerns are basically the language of the law seems to present a heavy-handedness,” Costello said. “So there’s an attempt to use alternative language that’s more property owner friendly.”

Under the proposed regulations as they now are written:

• Property owners would not be able to abandon, dump or store any nuisance items, hazardous materials, debris or litter.

• Lawns or ground coverings would have to “be kept trimmed to a height of no more than 10 inches, while hedges, bushes and shrubs could not become overgrown or unsightly when exposed to public view.”

• Dead, damaged or diseased trees or shrubs that present an imminent hazard would have to be removed.

• Properties would have to be maintained in a way that prevents soil erosion and sedimentation.

• Having two or more “unregistered, old or second-hand” motor vehicles that are not intended for use on public roads would be prohibited. The same prohibition would apply to old boats not intended for water use.

• Trash containers would have to be removed from curbside no more than 24 hours after being emptied.

• Building exteriors could not have loose, broken or unsecured objects or materials, including windows, shutters and gutters.

• Structures not “inherently resistant to deterioration” would have to be coated, treated or sealed.
