Verona Retains Law Firm for Potential Clean Water Litigation Over PFAS Contaminants - TAPinto.net

VERONA, NJ — The township has selected a law firm to keep on retainer as it mulls legal action against the companies that Verona believes are responsible for the township's contaminated water.

At its regular meeting on Monday night, the Township Council passed a resolution to retain Kennedy & Madonna, LLP and their partner law firms to pursue litigation against the 3M, DuPont and other companies for their roles in exposing township drinking water to PFAS contaminants.

Nationwide, courts have found 3M and DuPont responsible for generating per- and polyfluoroalkyl substances (PFAS) that have contaminated drinking water across multiple states, according to a statement issued by Verona Township on Tuesday. Kennedy & Madonna has represented clients in litigation to obtain damages for this contamination.

The township will not incur financial cost for the litigation. The law firm will operate on a contingency basis, receiving payment from the court award only after a successful verdict or settlement. Municipal staff will assist Kennedy & Madonna with providing discovery and testimony as the case progresses.

“This action demonstrates that the Township Council takes very seriously the safety of our drinking water and its responsibility to hold accountable those parties who have demonstrated little regard for the needs of the public,” Verona Township Manager Matthew Cavallo said.

Upon learning that Verona’s drinking water had higher than allowable levels of PFAS, the council and administration shut down remaining wells and switched to the Passaic Valley Water Commission as its water source until the local wells are deemed fit to use again. The PVWC's water has tested within safe limits.

The Verona Township Council approved a $500,000 bond ordinance for planning of improvements to township wells on Linn Drive and Fairview Avenue.
