  • OSHA's Emergency Temporary Standard (ETS) doesn't obligate employers to pay for required weekly tests of unvaccinated employees.
  • Some large and midsize firm leaders said they'll put the cost on employees, while others are waiting to see if the ETS survives legal challenges.
  • Employees with religious or medical accommodations may lodge challenges to being required to pay for their testing, said one employment lawyer.

If it survives the numerous legal challenges, the Occupational Safety and Health Administration’s latest rule requiring businesses with more than 100 employees to mandate COVID vaccines or receive weekly tests is set to go into effect on Dec. 5. By Jan. 4, employees must have received their final vaccine dose to avoid weekly testing.

OSHA’s new Emergency Temporary Standard, released last week, doesn’t obligate employers to pay for their employees’ weekly testing, but large and midsize South Florida law firms with unvaccinated attorneys and staff will need to decide whether to pay for the tests or let employees foot the bill.
